Section 106 planning obligation accounts
Planning obligations, usually secured under section 106 of the Town and Country Planning Act 1990, are legal agreements between local planning authorities and developers. They impose financial and/or non-financial obligations on a developer that bind the land subsequent to the granting of planning permission. Planning obligations enable the Council to secure contributions to the infrastructure, amenity and services necessary to facilitate proposed developments and meet the needs of those who live, work or visit Tower Hamlets.
You can view a list of the Council's current section 106 agreements that contain financial obligations which details all the planning obligation monies which the Council is currently in receipt of and includes a description of how the particular contribution will be spent - Section 106 agreements (pdf 44kb). This publicly available list also allows direct access to individual section 106 agreements and their respective Heads of Terms (details of secured financial contributions, improvements and community benefits). The list represents all financial planning obligations either awaiting expenditure or that have been expended but have not yet been drawn down from the section 106 accounts. It is important to note that although section 106 monies are expended throughout the year, the monies are deducted from the section 106 account at the end of the financial year, in line with Council's financial policies.
The information contained in the list is believed to be correct at the time of publication and will be updated quarterly to reflect incoming receipts and updated at the end of the financial year to reflect Council’s expenditure.
