Background review of land charges
The local land charges service performs a statutory function
under the Local Land Charges Act 1975, the Rules of 1977 and the
later Local Land Charges (Amended) Rules of 1995.
The Act was originally designed to ensure that purchasers of
land and property were not caught unawares by certain obligations
and restrictions placed on the land or property under statute,
which are binding on successive owners of the land.
The land charge function is to provide information held on the
local land charges register for any member of the public who
intends to purchase a property in the borough by accessing various
registers held by the council. This includes documents for
registration, for example, planning permissions, section 106 legal
agreements, building regulations notices, improvement and repair
grants, financial charges, environmental health notices, listed
building charges and highway agreements.
Four main council departments contribute to the replies given by
the land charges service. They are the development control,
highways, building control and environmental health services. The
other departments who supply information to the register are
finance, grants, property services and historical buildings
section.
The search fee is currently £155, part II enquiries cost £30
each and searching any additional parcels of land are £30 each. For
an expedited search the fees are £190 (expedited service
currently not available).
