Non-domestic rates (NNDR)
We no longer publish non-domestic rates (NNDR) data on business rates
The council previously published data that related to commonly requested information on business rates. These are also known as Non-Domestic Rates (NDR) or National Non-Domestic Rates (NNDR).
However, a First-tier Tribunal (Information Rights) decision (EA/2018/0033) found that NNDR account information is capable of being confidential in nature. That meant that publishing it would be an actionable breach of confidence.
Due to this, this information is exempt under Section 41 of the Freedom of Information Act (FOIA). This is an absolute exemption and is not subject to a public interest test.
The Tribunal also found that disclosure would be likely to prejudice the prevention of crime under Section 31(1)(a), and that the public interest favours maintaining this exemption. In addition, information relating to sole traders and partnerships is exempt under Section 40(2) (personal data).
A further First-tier Tribunal decision (EA-2022-0181 / EA-2022-0203) confirmed that there is a clear causative link between disclosure and a real and significant risk of prejudice to the prevention of crime.
As a result, the council has withdrawn this dataset on the basis that it is exempt under Sections 41 and 31(1)(a) of the Freedom of Information Act.
Can you request data if the council is the account holder?
Yes, we are able to provide information where the council is the account holder, subject to Section 40(2) (personal data relating to living individuals).
The council considers that these exemptions apply to customer accounts.
